    I'm having trouble finding if its legal to keep standard magazines in a locked container while traveling in or through DC. I just got my DC CCP license. If I put in a DC compliant mag then keep the standard mag in a locked container while in DC is this legal?

    § 7–2506.01. Persons permitted to possess ammunition.
    (b) No person in the District shall possess, sell, or transfer any large capacity ammunition feeding device regardless of whether the device is attached to a firearm. For the purposes of this subsection, the term “large capacity ammunition feeding device” means a magazine, belt, drum, feed strip, or similar device that has a capacity of, or that can be readily restored or converted to accept, more than 10 rounds of ammunition. The term “large capacity ammunition feeding device” shall not include an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.

    Thank you. I thought FOPA would at least cover driving through. It looks like FOPA would cover a firearm but not magazines or an unregistered caliber of ammunition?

    Thanks for the source. Penalty for having a magazine is pretty steep.


    (4) A person convicted of possessing a large capacity ammunition feeding device in violation of § 7-2506.01(b) shall be fined no more than the amount set forth in § 22-3571.01, or incarcerated for no more than 3 years, or both.

    (6) $12,500 if the offense is punishable by imprisonment for 5 years or less but more than one year;

    FOPA is regularly flouted in NYC and NJ by state authorities.

    But yes, conviction in DC for the mags is a prohibitive offense from legal firearms possession.

    And that is why everyone who can, should stay the hell out of Washington DC. If I didn't need to go there occasionally for work, I would NEVER set foot in our Nation's Capitol... and isn't that a little sad.
    I made it a personal rule years ago that I would never enter DC unless I was being paid to be there.

    How do you all get from NOVA to MD on the southern route??
    A sliver of the Wilson bridge route is in DC,, I am honestly expecting the day there is a "roadblock" style stop and search on the Wilson.

    look, >10 round mags were converted from a misdemeanor to a felony in DC about three years ago. Outside of FOPA protected travel, if is loaded or unloaded, locked or unlocked and whether or not you legally have the gun it goes to with you or out of state, is a FELONY. You will not just lose your carry permit, but you will lose ALL your rights to possess a gun anywhere in the US -- for life.

    Don't do it.

    As far as FOPA you'd better be 100% in compliance with fopa conditions. You'd better know them, take a look at the case law and conform 100%. If you conform 99%, but not 100% you are goin to prison and will never legally possess a gun again.

    if you 100% comply with fopa, be aware it is an "affirmative defense" and they can arrest you, cuff or zip tie you sittingo district and are not Frd. You can't sue for false arrest, you only get to use FOPA in your trial and if you prove 100% compliance they you get a not guilty verdict.

    Your asking "while traveling in or through DC" worries me. FOPA is only for "through." If you stop to go to your office, someone else's office, to pick up or drop off a pal, collect your wife from the museum, you are not traveling though and you are not making only stops necessary to your transit of DC, and you are going to be in s4it. And that includes if your magazine is empty, and in a $5,000 safe in your trunk - and even if you dont have the gun.

    This is a Maryland forum. Maryland, just like DC, arrests people who are 1% non compliant with FOPA. You can transit DC with reasonable and necessary stops, with proper securing of firearm transportation specified in FOPA just as you can Maryland. In both you are protected by federal law, and in both if you make one tiny mistake they will f you up.

    Rascal - understood, not trying to commit a felony. A normal trip to DC is planned for me so putting in my 10 rd mag is not a problem. My thought was if I'm already out somewhere and decide to make a last minute trip for lunch or something into the city can I stay legal by locking up a mag. Or traffic gets diverted because of a major accident on 495 and now I'm in DC. Just looking for ways to stay legal.

    FWIW, DC gave up ownership rights for the bridge and gave a permanent easement to VA and MD for the portion that goes through DC. Not sure whether it means DC can enforce their laws on the bridge, but it's pretty clear they want nothing to do with it.

    I've lived in this area since 1983 and regularly drive that segment of the Beltway, and I have never seen so much as a MPDC speed trap in that segment of the bridge. Every time I have seen an collision or broken-down car in that area, it's been MD or VA emergency services responding.

    As for the comment above about the safe or any other closed and locked container, LE would need to obtain either your consent or a warrant to open it. Unless they already have reason to suspect it contains contraband and can explain why to a judge, they're not getting a warrant. So don't store pot in there with your magazines; there is no such thing as a magazine-sniffing dog. Hopefully you'd know your rights well enough to not consent to a vehicle search.

    This is how I usually get from Maryland to Virginia without using the Wilson Bridge. It does add a little wear and tear to your daily driver though.

    I remember years ago, some poor schmuck, in keeping with Virginia law, had his shotgun mounted behind him in his truck, across his back window. He made a wrong turn and ended up going across Memorial Bridge. When he got to D.C., he immediately made a U-Turn and headed back to Virginia, but not before being spotted by D.C.’s finest. The cop followed the guy back to Virginia and pulled him over in Virginia. He was immediately arrested and charged with the illegal possession of a firearm.

    The cop could have let him return to Virginia. The driver clearly didn't intend to violate the law, and he returned to Virginia via the fastest way possible. None of that mattered. It cost the driver a small fortune to defend himself in court. Fortunately, the NRA got involved and was immediately criticized for inserting its snoot in D.C.’s affairs. But it got the guy off.

    In another incident, an elderly man got into an elevator. Three guys got into the elevator and attempted to rob him. He pulled out a cheap .25 pistol and shot two of them, with the third guy escaping. He was arrested and charged with the possession of an illegal firearm. The NRA came to his defense as well and the charges were dropped.

    Both cases were mean-spirited and it's a good thing he NRA was there.
