    Still no opinion in Dobbs. Pretty surprising.

    And no opinion day scheduled this week at all (so far). They are behind with opinions.

    Dobbs can't be imminent if a dissent has not been circulated.

    Or so they say…. The insider reporting this is from the conservative side. Or so they say, it maybe a ploy to just give a middle finger to the liberal side.

    Suffice it say, they will still issue it sooner the. Later. The sooner they can release it, the sooner they can get it out of the news and get the protestors to move along and be done with it. Once an opinion has been released it’s over.

    I could be wrong, but I do think NYSPRA will come before the end of the month. To many other cases pending with SCOTUS need an opinion issues so they can issue PC’s on the others. At least two cases on hold, and several more needing some for. Of resolution before end of June. So I think it will come sooner rather then later.

    I'd love to have this on Monday. But at this point, what is a few extra weeks. It will be the end of June in short order.

    I sure understand the impatience, though. I'm desperate for good news.

    I’ve been really encouraged by the leaked draft. Every critical analysis seems to point to a real focus on the underlying originalist message. It seems clear that Roberts likely wanted to keep the opinion narrowly focused on leaving Roe in place while supporting Mississippi’s law. However, The other 4 justices seem to support a much broader ruling. Should they broaden the ruling in this case, the implications could be quite profound. They could potentially correct some of the shortcomings of heller. Imagine 98 pages of opinion which cite the truly racist history of many state gun control laws, and how local governments used these laws to restrict the very civil rights the constitution was designed to protect.

    There are 37 opinions to release.

    The most mundane ones will be dropping to clear the way for the impressive decisions at the end of the session.

    Roe v Wade isn't politics. Its a pillar of an ideology.

    When this pillar gets pulled down, all of the other rights that have been invented out of thin air will be struck down eventually, as they referenced Roe v Wade as the template.

    The fact that they issue a written opinion is what separates them from politicians. At least that is what they claim.

    I think this is the most salient point here. The leaked draft opinion really has me hopeful that SCOTUS embraces their designated role in the government as arbitrators of the constitution and not lawmakers.

    When we confirm future judges we should not be asking them how they would rule on future cases like Roe, we should simply be asking them to demonstrate that they will simply fulfill their sworn duty to uphold the meaning and the text of the constitution.
