I think this is important, people, when we advocate for Hogan to veto HB1302 that we don’t argue against things that are not even in this bill, like transferring guns and not being able to legally get them back because they’re pre-ban.

My comments have to do with ownership and the Red Flag Law.

Title 1 Guns owned by an individual will be seized. Title 2 guns on a Trust with other Trustees MAY add some protections. IANAL.

I can guarantee this, if the Bill becomes Law, people will be targeting those in our community that can't hide behind a screen name/alias. Moderators, Dealers, and Members of FB and Gun Forums.

    What's the going rate for a confiscated pre-ban AR15?

Will the state be compensating us for the pre-ban AR15s?

Dear Governor Hogan, these are the questions that must be answered during your HB1302 veto deliberation.

you don't need to be a lawyer to see thru the thin veil they have in this law hiding the confiscation scheme. they want to get rid of the pre 13 guns that the fsa 2013 left in our hands. if they thought they could have taken them then they would have, now they are just going to use this bill if it becomes law to start then dumais will use the language and reasoning in the bumpstock bill to push for confiscation of semi auto firearms in the very near future since she has now set precedent that taking firearms, or parts and pieces, doesn't break the taking clause.

all the more reason to vote out everyone who voted for this bill, either time.

HB1302 gives the state the right to disregard *Due Process*. The State of MD will be able to seize all weapons you own under this law.

I would think if you are a party to a trust, all guns in that trust will be seized as part of the ERPO. Location is irrelevant.

Trusts are not entities like corporations. IANAL

for arguments sake lets say someone doesn't have all their firearms in one location and some locations are not even in this state.

then what does the state do and how do they know exactly what you have and what they are supposed to confiscate?

location would seem relevant if they think you have more than they find. how do they know what has been purchased face to face and what is stored where and with whom?

do they go interstate and attempt to remove things from other people in free America and how do they think that will work out?

will they do swat raids in southern va or in Pennsylvania or WV at peoples relatives and friends homes also?

this law is BS and they know it.

The Trusts language should bear out legal prohibitors. If a Trust owns a SBS 870, it can have 2 Trustees with completely different addresses. If one trustee dies or becomes prohibited the other one has not lost any rights as a Trustee.

Im not going to talk about it any more. I was just trying to show that there may be alternatives to loosing irreplaceable property.

    ...

IDK. If you knowingly withhold weapons when served with an ERPO order, I believe you are committing a criminal act.

and if said person has so much stuff that he may not remember where it is?

possessions still 9/10's of the law so non md regulated guns somewhere else can be given away or sold for 1 cent ahead of time.

removing stuff in ones possession here is one thing. expecting someone to state locations of stuff not in this state or in ones possession seems to break the 5th amendment. but since due process is gone out the window I guess md can do whatever it wants to trample ones rights.

I am not saying I think people should be trying to sidestep the law I am just so pissed off I cant stand it.

MSP has a corrupted list of your regulated firearms, so we start with that.

Corrupted, because they don’t remove regulated firearms from your rundown when you sell one. They just add that sold firearm to the buyer’s regulated list.

    How retarded is that?
