I filed my most recent stun gun case challenge today. We are challenging Hawaii's ban on stun guns on 2a grounds. I have already been successful in challenging New Jersey, New Orleans and Annapolis's stun gun bans. I am still litigating in New York state. Big Thank to LaRue Tactical for supporting the case.
I am going this with Stephen Stamboulieh

George Lyons took out D.C. and Baltimore's bans so after this all the is left is Rhode Island State and a few scattering of cities possibly. The only one I know of is Wilmington Delaware. If you know of any others pm me.

Attached is a copy of the complaint

I am going to do Rhode Island after the Mass. stun gun case being litigated by the Center for Individual rights is over. Mass. is in the same appeals circuit as Rhode Island so if that case gets appealed we would be bound by it either way.

I thought Young was also challenging the stun gun ban?

There are a lot of things going on in Young. In a best case scenario the taser component of the case is going to get remanded back to the lower court for a trial. And due to the procedural posture of the appeal it is a lot quicker and easier to just file a separate case rather than try to deal with all of it in one case.

Bump on this one. Today, the Hawaii taser case is still going… (pardon any spelling errors)

the caetano case was decided in 2016 iirc. Hawaii was not budging in 2018 when this thread started, and tasers weren’t legalized until 2022 in Hawaii.

today another installment was linked off the FPC twitter thread. Basically after delaying for roughly 5-6years, the state is trying to avoid the damages part.

not sure what damages were asked for, didn’t hear those in the notes today but the attorney, Stamboulieh, is asking for the resolution of the damages part of the case, and lifting the stays that have been in place for a number of years after the caetano ruling… where the state did not honor the 2016 ruling…. From 2016-2022.

link here… it’s stagnant waiting to start for the first several minutes then goes for about 20m of the presentation of the case... and Hawaii guy ask for dismissal for sovereign immunity.
