    So those two that carried into the House/Senate office building were charged with breaking an unconstitutional law.

    Does this mean those charges must now be dropped?

    Judge Sculin wrote "there is no longer any basis on which this court can conclude that the District of Columbia's total ban on the public carrying of ready-to-use handguns outside the home is constitutional under any level of scrutiny.”

    I was losing hope on this one. VERY exciting. DC will have to pay SAF fees correct?

    I have not read the enjoined sections completely but it looks that way from 10,000 foot.

    HOWEVER there is a mine field of federal issues - from gun free school zones to property restrictions to national parks to, "just cause we can."

    Not everything in DC is "DC".

    Get caught and you will be a test case.

    I would expect an emergency stay in about 24 hours.

    I am not offering legal advice on behalf of anyone, but as a friendly guy I say, "don't risk it."

    Not until they've (DC and the PD) been Officially Noticed and Served a Certified Copy of the ruling, just as the decision states. I doubt that will happen by tomorrow. Be careful out there!

    After that, the skys the limit (for you as a test case .... just plan on spending a few days in jail... ;) )

    Is anyone else feeling skeptical about this? Will they just make it as tough to CC as MD? I have been waiting for a chance to use this though:bannana:

    My guess is they will make it more like NJ. Much harder to get a permit in NJ then even in MD some people actualy get premits in MD. The only things that might stop them is the fact that a district court judge is watching them to make sure they don't do anything the judge see as attempting to ignore his directive. It is also possible congress decides to step in but I have no idea what that entiles if it requires the Senate or Potus to do anything that isnt going to happen.

    That is quite true.

    But I wonder if they could even do that given that the decision relied extensively on Peruta which specifically called out the circuit decision in Drake v Filko as being a de-facto ban disguised as reasonable regulation?
