Ok I just watched on WBAL that legislators are trying to push domestic violence victims and people with protective orders to the front of the handgun permit line...

The guns seized are secondary in this case, but an obvious concern.
The primary issue is that if he is convicted, he will never legally own one again.

True. Good luck to the OP, if there's a conviction he's done. He'll be a prohibited person and can never legally even POSSESS a firearm again under the GCA.

Then, you make sure that the DA files charges.

(That's provided that she's not accessing this site.)

Change ALL of your passwords for ANYTHING that she might have known or have access to.

Also, if she has access to any computer you currently use, make sure that you wipe it.

A gun owner can actually be very vulnerable sometimes. All it takes is for someone to make an accusation and your collection can be gone in no time. We are held at a higher standard than non gun owners.
Reason why I never show my guns off. People I know have no idea what they look like, how many I have or that I own guns to begin with. They go straight to the safe when I return home from the range/hunting and I try not to get noticed when I get them out of the car.
All it takes is one anti-gun neighbor to say some BS and you will have a lot of explaining to do before you are cleared.

That's ridiculous that even after she admitted that you didn't hit her. The state decides to continue pressing charges? What the hell is the point of that? They just get a hard*n for giving out domestic abuse charges?

There ia a lawyer near the courthouse in Towson is very good he is less than a block away forget his name and will get it if you pm me. Saw him work ,has big mean teeth. She will not like you after he is done.

Do yourself a favor. Contact this attorney and see what he has to say. He is a bulldog. A very serious bulldog. I'm not kidding. I'm not saying he will take the case but if he won't, ask him to refer you to someone.

There's a "Do I have a Case" form on the web page where you can submit your situation.

    Update:

First thank you for all of the support and advice offered so far, I really appreciate it.

Based on some posts on here I have refrained from posting until the court case was resolved.

I was suspended from work 5/3/09 pending the result of the trial.

So my case was dismissed due to lack of evidence 5/22/09

I was fired from my job (NGC Engineer, secret security clearance) on 6/12/09 for the following: "We have considered the circumstances underlying your recent arrest and have made a decision to separate you..."

My lawyer and I have made several phone calls to Baltimore PD Evidence regarding my property to no avail.

I was told that an officer Posani (410-396-2499) must sign off on my guns for them to be released. Numerous calls to him have not been returned.

Today I spoke with the evidence room again, officer "Trish" (410-396-2048) was all she would give me...

She told me to call back Monday, and then asked "...are these guns?- Oh, cause once a gun comes in here it never leaves"

So if anyone has any advice on next steps to take I would be grateful.

I would like to talk to an employment lawyer regarding my termination as well if anyone can reccomend someone.

Also, the court has not released my $10,000 "cash only" bail money. It has been 4 weeks now.

    Thanks,

    Erik

Dude. :( I'd also consider a lawsuit against your employer for wrongful termination. The state of Maryland said there wasn't enough evidence to prosecute yet THEY thought it was enough to FIRE you? ********. I haven't read the thread but this is my reaction to your latest post. Get a damn lawyer man!!! I hope you get your guns and money back. :(

Related question: HOW did BMore PD take your guns? Full out raid or what?

That's exactly what I'm facing! The girl has admitted to me now that she made up the abuse because she thought I was cheating. In MD though, she can't drop the charges, the state will pursue on their own...

I guess in MD your "innocent until accused!"

shouldn't there be an issue of filing a false police report as well as the issue of deffamation of character / slander etc?

Go to the police station in person and make them tell you to your face that Posani is not available or whatever. Keep returning and keep asking for him. Send him a registered letter as well asking for your guns back so you know he recieved your request. Hound him until you get a response.
Write down everyone's names you speak to so if you have to sue you might be able to summon them to court.

Yeah a personal visit forces them to either shuffle you out looking guilty or give you a straight answer. Easy to lie or BS on the phone, not as simple in person. ;)

I'm glad you let us know the outcome. I'm sorry to hear what happened. First, your guns are your property and they should be returned. The others on this forum will have a better experience with that. However, with regard to the job, MD is an at-will employment state. They can terminate you at any time for any reason. You also have the same right to leave at any time for any reason. Therefore, it's going to be hard for a judge to side with you, unless they settle with you out of court and pay you off. If you accepted a severance, you probably signed away your rights to fight them when you took the money. The nice thing is that your clearance debriefing allows you to find another employer who will sponsor your clearance within the next 2 years and it will not cost them a lot of money. There are plenty of clearance jobs out there right now. Good luck!
