    The tracking number will clearly define if there was a new label applied. I find it strange that the LE would confiscate items when it's unknown if it is illegal.
    The person that signed for the item should be responsible for the item - regardless of the location.

    Still not in front of computer. Been running around all day but I just got off the phone with THE sheriff, Sherif Cameron and he set everything strait. Ill be picking my uppers up here in about an hour. Will update when I get home

    If it happened to me, I would contact the Sheriff himself and give him a chance to quickly make it right. If he was unreasonable or uninformed, I would contact a lawyer.

    I would have a LAWYER write to the Sheriff, copy to George R. Sparling, Esq., County Attorney. There are reasons why lawyers exist. Your situation is one of them. I would also have your lawyer contact the FBI.

    I find it strange as well, but then again this is Maryland and the OP DID have a bunch of big black scary guns/parts delivered to a shopping center... I'm assuming the shipping store there as I live nearby and there is a shipping store...

    ETA: I'd be interested to know the outcome of this, so OP, when you get your stuff, let us all know if either UPS, a shipping store, OR yourself made a mistake on the address so that at least blame can be placed where it belongs. Thanks!

    Sounds like he's got a case against only UPS. They put the wrong label on. You can't fault the restaurant cause the package was addressed to them. The police aren't going to catch flak because the proper person is getting their property back and there aren't going to be criminal charges.

    I used the word "may" As in "may" have a case against...

    If it were my stuff, I would be on the phone with an attorney and would try to be in his/her office ASAP discussing my options.

    Any of you stop to think that the girls working at DB's could have just not noticed the label? How many packages do they get on any given day? Anyone know? How many of them do they open a day and find semi-auto parts in... in todays climate of shootings happening everywhere?

    What if someone received the a box with the uppers in them along with some other boxes and stacked them somewhere in a pile to be opened later. Then someone else comes along and opens them... They're boxes, all of them except one is addressed to DB's but they're in a pile like they always are and they're 'just opening the packages like usual'.

    I've got no dog in this fight, but I'm surprised at how fast you guys are to throw blame and talk bad about people. Mistakes happen. OP will probably get his uppers Monday and everything is fine. If not, blame the sheriffs office.

    Some 18 or 19 year old girls and boys working at a local restaurant or even a manager or owner there accidentally opens them.... of course that stuff is going to weird them out. You think they know the ins and outs of gun legislation OR do you think they see some kids getting shot up at schools and malls every other week and just opened a package of "wtf is this"?

    We don't even know for sure that the address is right on the package as the OP hasn't seen it yet.

    Just saying, I understand where everyone's coming from. By all means, if the Sheriffs dept doesn't give your stuff back pronto you should lawyer up and get your sh!t. Just crazy how fast people are to judge. I'm sure nobody here has made any mistakes before.

    Just my 2cents.

    Let's see how laid back you are when it's your shit that gets got.

    All is good to go now. Sheriff Cameron had one of his deputy’s return what’s rightfully mine and everything is in good shape.

    Now that I have the package in hand it’s apparent that the shipping label does in fact have DB McMillians printed on a small sticker and it placed over only my business name, not the rest of the label. The location that I have my packages shipped to has an almost identical address as DB’s, so I guess someone at UPS wasn’t paying attention and just slapped a DB McMillians sticker over the label thinking that the business name was incorrect. This is just my best guess. I won’t have a definitive answer until I make a very serious phone call to UPS on Monday. Regardless, the rest of my info was on the shipping label. My name, phone number, invoice outside of the package and invoice inside of the package were all present.

    This can be debated till the sun comes up but here’s the way I look at it. This was a colossal **** up on more than one account. UPS made the first mistake and they’ll be hearing from me first thing Monday. Ill-informed and brainwashed employees at DB McMillians made an irrational decision to call the police rather than the phone number on the god damn package. I blame the liberal media for that one. As for the Saint Mary’s County Sheriff’s office, they worried me at first but ended up fixing things very quickly! Naturally I was a little freaked out over the situation. I did have 10 upper that were on backorder for almost a year taken away from me.

    Why it would take until Monday to figure out that uppers are non-regulated? I have no idea. A quick phone call to the head honcho swiftly fixed that issue and I can’t speak well of him enough for the way he handled the issue.

    I'm just saying lets have all the facts come out before rushing to judgment against people that may or may not be to blame. That's all.

    Once the whole story comes out, then have at it.

    Lawyers are expensive. I'm going to call the NRA on Monday if I don't get them back.

    Not to be a dick, but you'll dump $5,000 on business costs and not entertain an attorney because they are "expensive." If you don't want to call one that's your business, but don't complain about anything that comes from this.

    Had you called a lawyer before coming here, (s)he would have advised you not to talk to anyone, let alone post it to the Internet, where the Sheriff's Dept. is likely to discover it. I haven't read the rest of the posts yet, but if you are proceeding pro se (without the advise of counsel), please do not pay out any strategies online.

    Glad you got your stuff back. Suing would be somewhat wasteful since you really have no damages.

    Maybe posting the situation on here is what prevented me from needing a lawyer in the first place.

    I just finished the thread. While the thread did help you, you took a 50/50 gamble on either 1) getting your uppers back peacefully or 2) dealing with a shitstorm of a legal mess. A call to your friendly, neighborhood lawyer should be your first discussion. Some lawyers give free consults.

    Really though, as a business owner you should have a lawyer you can call in a pinch.
