Is it legal to have an out of state FFL receive a transfer for you for a non MD regulated weapon?

Similar to buying a cash and carry item from an out of state FFL?

This is a bit confusing and not sure if I am being clear, so an example.

FFL in South Dakota has a shotgun I want. Rather than ship to a MD FFL, I have him send it to a PA FFL and go and pick it up there.

I buy non regulated guns from an FFL in PA all the time cash and carry. (High Rock) If it is NOT regulated in MD, I think you just goto PA and get it. They do a background check...... The transfer is there because over state lines you can't send/ship to an individual.

Now, I am not an expert but that's the way I interpret it....

First let me ask, what's the point of that? If it is an unregulated item, whatever the PA FFL will charge you will most likely be close to, if not the same as what the MD FFL will charge you.

I'm with Merlin - I don't get why you would go through all that trouble. The feds know, so will Maryland once they pull you up in the system, if they ever wasted their time to do so.

Sounds kind of ridiculous to me. But I'm not sure what you are trying to accomplish by buying a shotgun from SD and having it shipped to PA vs. MD.

Not true. There are a lot more Pa. dealers so there is more competition. One Pa. dealer was doing $25 transfers while most Md dealers were in the $50 range or higher.

Add in slightly better prices (due in part to competition) and possibly more convenient hours and it's a no brainer.

    YMMV

    Why is that?

I have a long relationship with the FFL I dealt with when I lived there for 10 years and like giving them the business since they know me and they don't give me a hassle on anything.

Since most of what I acquire tends to be at the Chantilly gun show or shipped in from out-of-state, it doesn't matter where I do the transfer and I know these guys will not jerk me around. Especially on a "Delay, Default Proceed".

As long as your not spending $20 on fuel to drive back and fourth to PA. And Is that the reason? At $25 it must be one of the home based FFL's PA has. But I ask again, is that the reason?

PA FFL's do tend to be cheaper. More competition AND less overhead in many cases. Ask some FFL's that do gun shows in PA, but I don't think you will find a ton of them. MD regs and requirements lead to higher overhead. That is one reason guns are more expensive here to begin with. It's not just competition, it is state requirements and oversight that get rolled.into higher overhead and thus higher pricing.

Our MD FFL's have a hard time competing for.private sales when competition goes across state lines
    And that is on purpose.

Yes, but as you say: only for non-regulated firearms.

Exactly like that, the situation is the same except you had the gun ordered in and not the dealer.

    Sure.
Why not? Who cares? Not that it matters to the OP's question, but here is just one reason:http://www.mdshooters.com/showthread.php?t=66010, plus this:

Purchase of non-regulated firearms from a contiguous state is 100% legal and the firearm maybe brought into Maryland. There is a NICS, PICS or VICS check done and the LGS is required to give the residence state, address and ID type, that is noted on the record. But if you purchase anything that is regulated, banned or limited in the State of Maryland and bring it over the state line, you may have just committed a crime. Chris

Where I live I have to spend $ on fuel to drive to most any gun store so I might as well try and recoup that cost by soending less on the transfer fee.;)
