Mental Health Inspections/Exams to be required in Maryland.....

Yes, you read it correctly folks....I'm looking for written details on this which even MOM's office don't have a press release for yet but apparently MOM has signed by Executive Order the requirement of a Mental Health Exam for anyone wishing to purchase a Handgun.....

Welcome to New Jersey..er I mean Maryland folks!

There are apparently two other things that he made an executive order about wrt firearms but I'm having trouble securing details....

I really hope that my sources are wrong....

I hadn't heard anything about that, but anything is possible in this nutty state. I don't see how he could, legally. (Which is not to say that he wouldn't.) It's not in the law and I would say that's quite overstepping any authority he has. They're already pushing the envelope with saying a mental health records release & possible investigation is authorized as "part of a form required by the Secretary." That's one of those things that you almost wish they would do so maybe the general population of the state will wake up.

Of course, they can always do anything they want and respond with a typical "we're acting in good faith, just sue us if you don't like it. Our lawyers are many and cost us nothing extra to use." Not like they're the ones who'll have to pay any potential judgment anyway. That'll be up to the taxpayers.

Would like to hear what those other two things are as well???????

I'm trying to get solid info....

I can't find anything in Md Law that would grant him the power to do so.

I doubt the veracity of this. The governor's website is very frequently updated, and if this occurred today he would've posted it:

I really hope this is wrong but it was informally confirmed by someone in a position to know.

The new form was a push from the MSP Chief (AKA directed by MOM)....to require a mental health exam would not be too much of a stretch past that.

Furthermore Md Code states below....and I'm sure MOM could try to work some "Magic" with that.....

§ 14-301.

(a) In this subtitle the following words have the meanings indicated.

(b) "Energy emergency" means a situation in which the health, safety, or welfare of the public is threatened by an actual or impending acute shortage in energy resources.

(c) "Public emergency" means:

(1) a situation in which three or more individuals are at the same time and in the same place engaged in tumultuous conduct that leads to the commission of unlawful acts that disturb the public peace or cause the unlawful destruction or damage of public or private property;

(2) a crisis, disaster, riot, or catastrophe; or

(3) an energy emergency.

So who were the 3 or more individuals who committed mass murder together in MD with handguns recently?

I guess all the nuts can go buy shotguns and rifles- does O'Malice know that Eric and Dylan used shotguns and a rifle among their little arsenal at Columbine? If memory serves me they used shotguns in the library to kill most if not all they killed in there.

oops.. shhhh, don't give O'Malice any ideas...

Do any of these liberals even have 1 brain cell between all of them?

BTW I want to add, if this hysteria is all because of April 16, 2007, that quite a few of the mass murderers used rifles and shotguns.

some samples:

-Charles Whitman, Texas clock tower- rifles
-the guy who killed 35 in Tasmania- semi auto rifle
-Patrick Purdy - semi auto AK- rifle
-James Huberty- had handguns but was fond of his semi auto Uzi carbine ( defined a rifle)
-Mark Lepine- ( Montreal college shooting- incidently engineering students in the 2nd floor classrooms- sound familiar?)- mini 14 rifle

I'd be more worried about this part. After all, we are under the jurisdiction of the Handgun Roster Control Board.

Folks...

Longs story short, one of our elected officials informed me today that he was told that MOM signed 3 exec orders today that were firearms related.

I made some phone calls and a person that shall remain unnamed that works in the Exec Branch that told me that they had been told that MOM had signed an order that would "Require a Mental Health Exam to purchase a Pistol"....word for word.... but that she had not seen written confirmation yet nor did they have details on the other two.

A few other folks have told me that they "Are unable to confirm any expansion of the current mental health requirement at this time".

If/when I get any more info I will post it but I really hope that all of the parties involved were mistaken.

I don't believe we're so much under the Handgun Roster Board as we are under the Firearms Licensing Division of MSP, as dealers/owners/purchasers of regulated firearms. And note that dealers of regulated firearms must also have a state license in addition to their FFL which is administered by MSP. The roster law only applies to licensed dealers and the board only has authority over the gun list. But in the end it's the same effect I guess anyway.

I could see where he could try this. But it's clearly an abuse of power that I don't even think the leftist courts in this state would allow. Heck it may even cause the NRA to get off their asses and spend some money on some legal challenges here.

I hope this is not the case either. But take heart, it may well be a pyrrhic victory to the antis if it is true. Even the Fudds and Henry Homeowners who only want one gun for their house are going to be furious when they learn they can't get one unless they get a note from the Happy Doctor.

Really, even as arrogant as I know (and I do know) this prick is, I don't see him as being that stupid. But then again it's MD, so who can be sure.

I'm thinking, trying to reconcile this scenario with what jpk was told and what I think they would try down at the Kremlin on the Severn. Remember that Md. law does not totally prohibit someone w/ a mental disorder & a hx of violence or a 30+ day stay at the Thorazine Ranch from owning/purchasing a regulated firearm, it says they can do so if they get a physician's note.

I'm hoping O'Horny's order, if there is one, is something relating to the content of the dr.'s exam for persons who have a disqualifying history and what that exam must entail to be accepted. I know that has been a question mark with law enforcement for a long time, especially dealing with returning guns taken from people during mental episodes, what suffices as a doctor's certification.

I have no idea if this is the case, I'm just thinking out loud.

Then again, if O'Horny really wanted to make headlines and stand out nationwide, this would be a way to do it.

Am I the only one wondering why the local news media just started talking about the Executive Order that already took effect on August 1st this past week? Timing seems a little funny now with this popping up.

Officially the new form was not an Exec Order.

The decision came from the Head Honcho at the MSP.....we all know that he's a political appointee of OHorny and that he REPORTS to OHorny so....the order REALLY came from him....
