Non Resident Transfer to MD Resident

    Not sure if this is the correct place to post this but it seemed the most logical.

    Have a friend who is FED LEO and spends quite a bit of time in MD.
    He is a Florida resident and still has FL drivers license.

    I'd like to buy a pistol from him. He has it here in MD (legally) but I'm not sure how to go about the transfer.

    Do we:
    A) Simply go to a MSP barracks to do this or,
    B) Go through a FFL here in MD? Or,
    C) have an FFL in Florida send it to an FFL here for the transfer?

    Thanks in advance. I'd appreciate any suggestions and/or links to a government web site that has the details how to do this.

    I don't know but I would give an educated guess that going through an FFL in mandatory being that the guy is from Florida...

    Out of state sales to MD residents require going through a FFL. Some FFLs will let him drop off the pistol, but others require him to ship it from his home state. MSP only handles transfers (sales) between MD residents.

    I'll look for an FFL that wll let him drop it off and handle the transfer.

    The trooper at the front desk is going to ask for ID. If the guy can't produce a MD DL/ID, the trooper will send him on his way.

    If you can produce documentation that the seller maintains a residence in the state of Maryland, then he can purchase and sell a firearm in this state.

    While he's here on a "regular" basis; no established residence in MD and travels frequently. The latter makes this task very challenging.

    Before you say all he needs is a residence in MD, you REALLY should look at what BATFE says about residence.

    It is NOT as simple as having an address in the state. EXCEPT for full time students and active duty military.

    Best way, go through an FFL.

    Bring each of yourselves and the gun. Do you have your HQL or are you/the transaction HQL exempt? We are open Tuesday-Friday 10am-7pm and Saturday 10am-6pm. Bring it in any time we're open, and we'd be glad to help. :thumbsup:

    Standard transfer fee of $50 + $10 for MSP, so $60 OTD.

    The fact that this question needs to be asked is further evidence that Maryland's various government branches violate the 2nd Amendment.

    Wrong. MSP handles sales/transfers from MD residents to out of state residents. Have done 2 of them last month via MSP. Can't speak to receiving from a non-resident, but any excuse to go to Engage is worth the time. ;)

    Unless the transfer involved intestate succession, or the MSP is also a FFL, that may have violated federal law.

    Yeap, MD resident to non-MD resident MUST go through an FFL, or vice versa.

    If you sold a handgun to a non-MD resident, that was not transferred through an FFL, you are in violation of Federal firearms laws.

    And for a handgun, the FFL MUST be in the state of the buyer's residence.
