    He had a reciept?:shrug: Maybe if he did not have one they assumed he bought it in MD at the illegal "greater than 20 round magazine dealer" in Baltimore..you know, the one downtown.

    His wife may have told the police he received the magazine in state or the arresting office may not know the law. Either way that charge won't stick. Unless they have documented proof it's hear say. Sometimes in these situations the police trump up the charges to make sure the DB is held and gets higher bail.

    Well, that's certainly different than the magazine charge. Looks like they rethought that one.

    This isn't the first case of someone being charged with possession of a +20 round magazine.

    If he's in possession of something on the assault pistol list, he's pretty much screwed in that regard.

    I'm no lawyer (duh, ain't THAT obvious?), but could the paper's report be somewhat accurate in thst the 20 round mag limit was passed under the same omnibus bill as the "assault pistol ban"....and when the reporter saw the statute being charged under got things a little mixed up?

    Probably be the first time a reporter got something about guns wrong.:lol2:

    4-305 is the magazine law!!

    § 4-305. Detachable magazines - Prohibited.

    (a) Scope of section.- This section does not apply to a .22 caliber rifle with a tubular magazine.

    (b) Prohibited.- A person may not manufacture, sell, offer for sale, purchase, receive, or transfer a detachable magazine that has a capacity of more than 20 rounds of ammunition for a firearm.

    District court data entry default for the charge probably just goes to "assault pistol law" since that's the section the magazine law falls under.

    The descriptive part on case search is from the language the commissioner selects when the defendant is charged. They have a charge book that lists the language, but on the more obscure charges its often entered incorrectly or they are not sure which choice to make. Go by the statute number to figure out what someone is charged with. In this siutaion the person is charged with violating 4-305.
