I understand that you can no longer purchase magazines in Maryland with more than 10 rounds. Can you purchase a 20 round or 30 round magazine from Virginia (for example) and bring it into Maryland?

    § 4-305. Detachable magazines -- Prohibited

    (a) Scope of section. -- This section does not apply to:

    (1) a .22 caliber rifle with a tubular magazine; or

    (2) a law enforcement officer or a person who retired in good standing from service with a law enforcement agency of the United States, the State, or any law enforcement agency in the State.

    (b) Prohibited. -- A person may not manufacture, sell, offer for sale, purchase, receive, or transfer a detachable magazine that has a capacity of more than 10 rounds of ammunition for a firearm.

The law does not include a prohibition for possession. You're not allowed to manufacture(means putting together a "parts kit" within borders), sell, offer for sale, buy, receive, or give away a mag over 10 rounds inside md's borders(where this law applies). If you go outside of maryland and buy a magazine legally in another state, then you possess it and may bring it back in because it was obtained where legal and possessed legally.

Summary, go outside of md's borders...buy whatever you want in terms of mag capacity...bring it home and use as normal.

poke around here to find md code. It won't really help you out with caselaw or anything, but can go a long way to helping you answer your own questions.

I don't think there is any caselaw whatsoever regarding the magazine limit. Cannot even imagine why that would make it to the Court of Appeals. Now, there will probably be caselaw regarding the Constitutionality of it in the near future when the 4th Circuit gives an opinion in Kolbe.

yup, I was speaking in more general terms regarding the utility of directly reading COMAR. It isn't as effective at completely outlining the ins and outs of defensive use of force, or even things like blade length and what exact types of edged weapons are legal to carry in different manners. Caselaw fills in the gaps a bit and clarifies some of those issues that aren't fully explained in just plain ol COMAR.

things like this really help expand on that if you know where to look and that they exist...

And the best part is if you live up next to Fawn Grove PA on our side of the Masey-Dixie, and your neighbor has some "assault boolit holding banana clips" that you want, just walk 10 feet north over the line, hand 'em over and walk back.;)

Your right, but when we get the same questions everyday, day in and day out, well you get the idea...:sad20:

Probably just about every single question has been asked at one point on these boards. Are you saying we should just shut down the boards to new posts and just make it an archive site?
