I believe that once an upper has been built into a rifle it can't then be changed into a pistol. He needs to get an HBAR upper ASAP, then he can get a fresh lower and put that AR pistol together.

So in order to finish as a pistol it would need a lower that is designated for a pistol? Once that's done all laws pertaining to pistols apply.

No can do. Built into a rifle first, has to stay a rifle.
He needs to either buy another lower and build as a pistol or sell the upper, QUICKLY.
The fact he assembled it that way even once, is a Federal crime.
He has made an unregistered NFA item. Same as a home made machine gun.

Lower can be pistol or other.
But you can turn a pistol into a rifle. But you may NOT turn a rifle into a pistol, unless it started as a rifle.
Pistol -> Rifle -> Pistol is legal
Rifle -> Pistol is illegal.
Anything to SBR without a tax stamp is illegal.
