I think NFA Branch is focused on OAL > 29"

    be careful

Yeah, I had planned to change to a brake anyway (due to sb281, not any desire on my part....This thing'll be loud enough!).

    ?
Does SB281 set a minimum overall length for AOWS? or are pen guns and forward gripped pistols illegal now?

No, they are pistols or AOW, not rifles.

Engage has an official letter in with MSP on pointing out that MD law says an SBR is a pistol, and that therefore, it is improper for MSP to apply FSA2013 for copycat RIFLES to them.

    ?
No minimum overall length, but if the AOW has a barrel less than 16" it needs to be on the handgun roster.

    -Jim

is that new? my super shorty is an AOW, and I'm sure it's not on the roster. Bought and transferred in MD. And I know my AOW mac 10 wasn't on the list [also bought and transferred in md.

Yes, MSP issued an advisory back in March that said since an SBR (barrel less than 16" is a handgun, they needed to be on the roster for SALES and TRANSFERS.

If anyone is interested, I FINALLY got my tax stamp yesterday on a Form 1 for a Sig P556. I got the pistol last summer, submitted to MSP in September, got that back in January and sent to BATFE, and got stamp yesterday. So now I can put the pistol upper on a rifle lower (on Sigs, the upper has the serial #, not the lower), and voila.

Oddly, no mention of "2 features". OAL is 30".

So do you have to go to the MSP to register the ar15 pistol first then fill out the form 1 once it is approved from MSP? I was just asking because I form 1 a lower this January and was disapproved even though the OAL was 29.5in. Reason was "md state law, assault weapon- prohibited, ar-15 imitation."

The ATF screwed up and shouldn't have disapproved your application. Call them and ask about it. Any SBR over 29" is definitely OK. Any SBR under 29" should be ok because it is a handgun and not a long gun under MD state law, but we are currently waiting for MSP to confirm that.

Okay thanks, I will call them today. I tried submitting it yesterday but had trouble so I will try again today. My two other brothers had the same issue and they got the same response.

I just got denied on a form 1 efile SBR. 29.7" The reason was given as a "technical problem" but they don't explain. WTF.

    "Reasons for disapproval"
"TECHNICAL PROBLEM ENCOUNTERED RECEIVING THE REQUEST, IF INTEREST REMAINS, WILL REQUIRE THAT YOU RE-APPLY, AS A TAX REFUND IS IN PROCESS. TEC 304-xxx-xxxx"

Comparing the denied form to my prior approved efile form 1 SBR forms its exactly the same except for the examiner name. Same uploaded trust info too. Ugh. Luckily, I'm not waiting to build this one just yet (have 2 projects ahead of it) so I guess I'll just reapply and see if their "technical problem" goes away. There is a phone # included that I'm wondering if I should call.

I would definitely call since yours should have been approved....at least based on everything we know right now. Seems like an issue on the web site screwed up your app?

I called them today. I was told that they are going to disapprove all .22 AR-15's SBR's because AR's are not listed as .22 LR on the handgun roster. WTF!????

Shouldn't matter on a Form 1. No sale or transfer involved.

I'm sure ATF is as confused as everyone else. They then ask MSP for guidance and MSP get the shovel, goes out to the barn, and brings back an answer.

We will need an IP to submit all the .22 copies to the roster as handguns.
