ROMANIAN TT-33 IS A C&R AS PER ATF IN D.C.

I am a FFL, so I called Southern Ohio Gun, where I purchased my Romanian TT-33’s from, and asked if it was considered a C&R. They said that ATF had not cleared it to be considered as such.

HOWEVER,

Here is the "Official Scoop" direct from ATF in Washington, D.C.

I called ATF - Firearms Technology Group - 302-260-5476 - talked (twice) with duty officer of the day. He researched the Romanian TT-33 and told me that it was a C&R, and that the addition of the safety had no impact on this classification. The reason it is considered C&R, outside the fact that it is over 50 years old, is that Romania is not on the list of Proscribed Countries. Importation of military munitions and firearms are not allowed from countries on this list. Since Russia is on the list, but soon to be removed, according to Mr Kingery, if it were made in Russia and then shipped to Romania, it would not be classified as a C&R. He told me that this list of countries can be found in the Federal Firearms Regulations Reference Guide in Part 447 Importation of Arms & Articles of War, Sub-Section 447.52. I have looked it up and confirmed what the agent had told me. Don't C&R Collectors receive this manual with their licenses?? If not, I'm sure that ATF would be glad to send them a copy.

I view of this, I consider sale of the Romanan TT-33 pistol manufactured and dated 1951-52-53, etc., in compliance with the ATF's rules & regulations regardless what others may think.

Seems as if JG Sales is on top of the info game more than SOG.

I have read on the errornet that if they are C&R their designation supersedes the import bans. I am not sure if the citation below is what they were writing about on the place I read it:
§ 478.118 Importation of certain firearms
classified as curios or relics.
Notwithstanding any other provision of
this part, a licensed importer may import
all rifles and shotguns classified by the
Director as curios or relics, and all handguns
classified by the Director as curios or
relics that are determined to be generally
recognized as particularly suitable for or
readily adaptable to sporting purposes.
The importation of such curio or relic firearms
must be in accordance with the applicable
importation provisions of this part
and the importation provisions of 27 CFR
part 447. Curios or relics which fall within
the definition of “firearm” under 26 U.S.C.
5845(a) must also meet the importation
provisions of 27 CFR part 479 before they
may be imported. After all, the Yugo 59/66 got imported (Supposedly directly from the former Yugoslavia) and Yugoslavia is on the import ban list:§ 447.52 Import restrictions applicable
to certain countries.
(a) It is the policy of the United
States to deny licenses and other
approvals with respect to defense
articles and defense services originating
in certain countries or areas. This
policy applies to Cuba, Iran, Iraq,
Libya, Mongolia, North Korea, Sudan,
Syria, Vietnam, and some of the
states that comprised the former Soviet
Union (Armenia, Azerbaijan, Belarus,
and Tajikistan). This policy
applies to countries or areas with
respect to which the United States
maintains an arms embargo (e.g.,
Burma, China, the Federal Republic
of Yugoslavia (Serbia and Montenegr o),
Haiti, Liberia, Rwanda, Somalia,
Sudan, UNITA (Angola), and Zaire). It
also applies when an import would
not be in furtherance of world peace
and the security and foreign policy of
the United States.
NOTE: Changes in foreign policy may
result in additions to and deletions from the
above list of countries. The ATF will publish
changes to this list in the Federal Register.

(b) Notwithstanding paragraph (a)
of this section, the appropriate ATF
officer shall deny applications to import
into the United States the following
firearms and ammunition:
(1) Any firearm located or manufactured
in Georgia, Kazakstan,
Kyrgyzstan, Moldova, Russian
Federation, Turkmenistan, Ukraine,
or Uzbekistan, and any firearm previously
manufactured in the Soviet
Union, that is not one of the models
listed below:
